Terms of Use
1. Acceptance of Terms
By accessing or using TaxFin, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. About TaxFin
TaxFin is operated by FinSmart Holdings (Pty) Ltd (Reg. 2026/469983/07), a company incorporated in the Republic of South Africa. TaxFin helps individuals capture and organise tax-relevant records — receipts, a mileage logbook and a tax-return checklist — throughout the year, and export them as a single file that they can send to their own accountant or tax practitioner.
3. Eligibility and Access
You must be at least 18 years of age to use TaxFin. During the private testing phase, access is by invitation only: an account is created for you by FinSmart Holdings. You sign in with a one-time code sent to your email address. You are responsible for keeping access to that email account secure and must tell us immediately if you suspect unauthorised use of your TaxFin account.
4. Fees
TaxFin is currently provided free of charge during private testing. TaxFin is intended to become a paid service. We will give reasonable notice before any charge applies, and you will not be charged without agreeing to the pricing first.
5. Permitted Use
You may use TaxFin only for your own personal tax record-keeping. You may not:
- Resell, sublicense, or share your account access with any third party;
- Use TaxFin for any unlawful purpose;
- Attempt to reverse-engineer, decompile, or extract source code;
- Use automated tools, bots, or scrapers to access TaxFin;
- Attempt to access another user's account or data without authorisation.
6. Your Data
6.1 Everything you enter into TaxFin — receipts, receipt photos, mileage logs and related information — remains yours. By submitting it, you grant FinSmart Holdings (Pty) Ltd a limited licence to store and process it solely to provide the service. We do not sell your data.
6.2 You can edit or delete any receipt or trip at any time. Deleting a receipt permanently removes its photo from our storage.
6.3 Receipt photos are resized and recompressed on your device before upload to keep storage efficient; the original file you select is not stored as-is.
7. Sharing Your Records
7.1 TaxFin does not share your records with any accountant, tax practitioner or other person automatically. There is no practitioner-facing side of TaxFin.
7.2 When you download or share your tax pack, you decide who receives it. Once a file leaves TaxFin — for example by WhatsApp or email — it is outside our control, and we are not responsible for how the recipient or the service you used to send it handles it.
8. Not Financial or Tax Advice
8.1 TaxFin is a record-keeping and organisation tool. It does not calculate your tax liability, file returns on your behalf, or constitute tax, legal or financial advice.
8.2 The readiness score, checklist, category suggestions and mileage claim figure shown in TaxFin are illustrative aids based on simple rules. The mileage claim applies a deemed rate per kilometre to your business trips; that rate changes over time and your entitlement depends on your circumstances. Confirm figures with your accountant or tax practitioner before you file.
8.3 Vendor-to-category matching when you add a receipt is an automated best-effort suggestion. You are responsible for reviewing and correcting the category before filing.
8.4 Where TaxFin links you to a wealth adviser (currently R&N Financial Planning, an independent business — rnfinancialplanning.co.za), that advice is provided by them under their own licensing and terms, not by FinSmart Holdings (Pty) Ltd or TaxFin. We are not responsible for advice given by R&N Financial Planning or any other third-party adviser.
9. Hosting and Data Infrastructure
9.1 TaxFin is hosted on Cloudflare's infrastructure (Workers, D1 database and R2 object storage). Sign-in codes are sent through Resend. Fonts are loaded from Google Fonts. Each provider's own practices govern their part of the service.
9.2 We use industry-standard security measures including one-time sign-in codes, session tokens and HTTPS. No system is completely secure, and you use TaxFin at your own risk.
10. POPIA
For the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), you are the data subject and FinSmart Holdings (Pty) Ltd is the responsible party for the personal information you give us in order to run your TaxFin account. We process it only to provide and secure the service, as described in our Privacy Policy.
11. Intellectual Property
All software, design, branding and content is the intellectual property of FinSmart Holdings (Pty) Ltd or its licensors. Nothing in these Terms grants you any rights beyond the right to use TaxFin as set out here.
12. Limitation of Liability
12.1 To the maximum extent permitted by law, FinSmart Holdings (Pty) Ltd and its directors, employees and agents are not liable for any indirect, special, incidental or consequential damages arising from your use of TaxFin.
12.2 While TaxFin is provided free of charge, our total liability for any claim is limited to R0 (zero Rand), to the maximum extent permitted by law.
13. Termination
You may stop using TaxFin at any time and ask us to delete your account. We may suspend or terminate access for breach of these Terms or, during private testing, at our discretion with reasonable notice where practical.
14. Privacy
Your use of TaxFin is also governed by our Privacy Policy, which forms part of these Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts.
16. Amendments
We may amend these Terms at any time, particularly during private testing. Material changes will be communicated where reasonably practical. Continued use after a change constitutes acceptance.
